Occupation Order ? We can help.
Our Family Law Solicitors will help you regarding all types of family law matters including divorce, separations, child access and other family-related matters. Our Family Solicitors are available over a phone call, email or in-person, whatever suits you.
An occupation order determines who is allowed to stay in the family home. It also prevents the other person (called the Respondent) from visiting/occupying the area or only allows occupying specific areas of the house. You may want to request an occupation order if you don’t feel secure living with your partner or have already left the house due to violence but want to come back by excluding the other person.
If you want to apply for an occupation order, our expert family solicitors will create your application and a statement outlining the facts of your case. Our family solicitors may want to interview witnesses to write and swear new testimonials if there are any witnesses. We’ll then file the application in court.
How our Family Law Solicitors can help?
With the wealth of knowledge and experience, we have one of the greatest teams of professional family lawyers in the United Kingdom. Our expert solicitors guide you in all areas of family law, including separation, divorce, prenuptial agreements, childcare, and financial settlements. When you are in need, we provide one-on-one consultation. Our experts listen to you, offer support, and present viable solutions for the best possible outcome for you and your family.
An Applicant may file an appeal for the following reasons:
- to impose the individual’s right to remain in the home;
- to require the Respondent to allow the Applicant to visit or stay in the home;
- to restrict occupation of residence (such as one may use which areas of the house and at what times);
- to provide safety surrounding the house to prevent an abuser from taking revenge
- to prevent, suspend, or limit the Respondent’s rights to occupy the house.
The court makes different orders based on your rights to property (such as whether you’re an owner-occupier or a lodger) and your connection with other individuals. It also recognises any child’s requirements. The length of the order depends on the facts of your case. It is usually granted for six to twelve months.
